Terms and Conditions of Sale
1. Purpose and scope
These Terms and Conditions of Sale (TCS) apply, without restriction or reservation, to all sales concluded by THEO BESSONNET (the “seller”) with non-professional and professional buyers (the “customer”) wishing to acquire the products and/or services offered for sale by the seller on the BeTechInfo website (the “site”).
They set out the conditions for ordering, payment, delivery and the handling of any returns of products and services ordered by customers.
These TCS are available on the Site at all times and take precedence over any other version or contradictory document.
2. Products and services
The products and services offered for sale are those shown on the BeTechInfo Site, subject to available stock and technical capacity to deliver them.
Each product is accompanied by a description prepared by the Seller. Photographs and graphics shown on the Site are not contractual and cannot create liability for the Seller.
3. Prices
Prices for products and services sold on the Site are shown in euros (€), including all taxes, excluding specific delivery or service execution costs.
The Seller reserves the right to change prices at any time, but the product or service will be invoiced at the price in force when the Customer validates the order.
4. Orders
The Customer selects the products or services they wish to order. They validate the order after checking the information and accepting these TCS. Validating the order means accepting the TCS in full.
Every order constitutes acceptance of the prices and descriptions of products and services available for sale. An order confirmation email will be sent to the Customer at the email address provided when ordering.
5. Payment terms
The price is payable in full by the customer on the day the order is placed. Payment may be made by contactless bank card up to €50, NFC mobile payment, bank transfer or cash.
Bank card payments are secure.
For any hardware order, the hardware must be paid for when the quote is signed. Labour will be deferred and paid upon receipt of the invoice, within the payment period stated on the invoice.
If payment is more than 30 days late, the service may be suspended until the account is settled. After more than 90 days of delay, the service may be permanently deleted and the contract terminated. For professional customers, late-payment penalties at a rate of 12% may apply, together with a fixed €40 recovery fee.
6. Delivery / performance of services
6.1. Product delivery
Ordered products are delivered to the address provided by the customer when ordering. Delivery times range from 2 to 14 days depending on conditions and stock. The Customer will be informed in the event of a delay.
6.2. Performance of services
Services are performed according to the terms and deadlines agreed at the time of ordering and shown on the quote or order confirmation. Otherwise, deadlines are estimates and may vary depending on the complexity of the service, parts availability and workload. Any order placed by quote, such as a website build or custom computer order, includes a deposit request to protect the seller. For delivered sales, the customer will be informed of the delivery time within 12 to 48 hours.
7. Cancellation and termination
For hardware orders, cancellation is possible within 24 hours after signing the quote. After this period, no refund will be issued.
For services, cancellation is possible up to 48 hours before the appointment without charge. After this deadline, cancellation fees of 20% may apply.
In the event of termination of a recurring service, one month’s notice applies.
8. Right of withdrawal (for consumers)
In accordance with applicable law, for any distance sale, the consumer Customer has fourteen (14) days from receipt of the product or conclusion of the service contract to exercise the right of withdrawal without giving reasons or paying a penalty.
Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.). Return costs are paid by the Customer.
For services, the right of withdrawal cannot be exercised if performance began before the end of the 14-day period with the consumer’s express agreement and express waiver of the right of withdrawal.
For website development, if withdrawal takes place within the 14-day period, 50% of the deposit will be refunded. After 14 days, the deposit will not be refunded.
9. Warranties
Products sold on the Site benefit from the statutory warranty of conformity (Articles L. 217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
If a product sold does not conform, it may be returned, exchanged or refunded. This does not apply to digital products.
10. Liability
BeTechInfo cannot be held liable for inconveniences or damage inherent in the use of the Internet, including service interruption, external intrusion or computer viruses.
11. Force majeure
The Seller’s obligations under these TCS are suspended if an unforeseeable event or force majeure prevents performance. The Seller will inform the Customer of such an event as soon as possible.
12. Intellectual property
All elements of the BeTechInfo Site remain the exclusive intellectual property of BeTechInfo. No one may reproduce, exploit, redistribute or use, even partially, any site elements, whether software, visual or audio, without authorization.
13. Personal data
The Customer is informed that collecting personal data is necessary for the Seller to sell, perform and deliver products and services. This data is collected solely to perform the sales contract. The data controller is Théo Bessonnet, reachable at contact@betechinfo.fr. The GDPR contact is the same.
Contract-related data is kept for the duration of the contract and any renewal. Order data is kept for three years for accounting purposes.

14. Disputes
In the event of a dispute, an amicable solution will be sought as a priority.
In the event of a dispute, you may contact BeTechInfo at contact@betechinfo.fr, mentioning “dispute” in the subject. BeTechInfo has not appointed a mediation body.
If no amicable resolution is reached, disputes will be brought before the competent courts.
15. Applicable law and competent jurisdiction
These TCS are governed by French law.
All disputes arising from purchase and sale operations under these TCS, including their validity, interpretation, performance, termination, consequences and follow-up, which cannot be resolved between the Seller and the Customer, will be submitted to the competent courts under ordinary-law conditions.
